Not sure he's actually shooting through the wall or if it's just the animation.  Might be like when your feet stick out through a wall when prone, the image doesn't match the player's perspective?

This is very similar to many spots on many maps where you can see over it with your head but your gun sticks through the wall. For example on Airfield on the left side of the radio building on the bottom floor you can slid up to the wall looking out toward the downed planes and tunnel entrance. All you can see is the very top of his helmet. His gun is shooting through the ground technically.

It's just an issue we will always have with polygon games. Can you imagin walking up to a wall and your gun scraping against it and going in all kinds of directions because it collides with the wall? Not something gamers want happening whenever they walk near a wall.

As far as our servers and what we allow and don't allow. I think it's just the same as many other spots you can shoot through. The issue I have with it is that it appears that his head is right up against the wall, not the window. From this angle he doesn't look like he is looking through the window but through the wall. This would not be allowed unless he was just randomly wall spamming.

I absoluely hate when the animations dont match the actual players view, its almost impossible to see people sometimes because of the horrible animations, I cant remember any issues like that in cod4.

It may be something we just have to accept about the game.  This is going to happen in so many places on all the maps it would be nigh impossible to police.  The other thing about the screenshot is you can't tell if he's actually shooting.  He could just be ducked under cover with sights up so he can pop out and snap fire.

We should check it out in game though.  Spend some time trying to see if it is glitching or not.

I think it depends on whether or not he can actually see through the wall and others can't see him.  If his left eye is actually looking through the bottom right of the window and is viewable from the other side, then that's just a game design issue.  On all maps there are rocks, sand bags, and walls that you can either crawl right through or have part of your body or gun magically penetrate.  In a perfect gaming world, if you were that close to a wall you shouldn't be able to sight up.  Your gun would get stuck and you would have to move back.  But nothing is perfect.
