If the win is determined by sales, I think it's safe to say MW3 will sell more.  The CoD franchise is extremely popular on consoles and PCs, while I believe the majority of the BF series has been mostly experienced on computers.
With that said, BF3 seems to be the best game to me (by far).

jablon51 COD has the same stuff in their user agreements. Stuff like seeing what hardware you have is used so they can give you default settings for graphics or sound. With out it you would have to manual set up video and sound every time. This is a non story made up by activistion. Read threw their user agreement. now with that said I plan to get both so I'm not trying to bash COD just trying to be fair and honest here.

I have played just about all the COD games and from what I see of BF3 if it lives up to the standards of BF2, there is no contest. The variety of the BF series offers way more than any COD can to this point. That is why COD puts out a game a year because it gets old after a while as I recall I played BF2 for almost 2 years and would have still played it if the number of decent servers had still been there.

Dont get me wrong I still play WAW and like COD4 too. All the COD series were good except MW2, that is mostly due to lack of dedicated servers. However, I just dont think COD can compete against BF2 or BF3 as long as it just doesnt bomb cause of game issues.
